Frequently asked questions
Straight answers, before you call.
Most people want three things answered before they talk to a lawyer: what it costs, whether we act on their kind of problem, and what actually happens on the first call. Here is all of it, in plain English. If your question is not below, get in touch and we will give you a straight answer.
What people ask us most
These come up in almost every first call. Read them before you get in touch and you will already know most of what you need to.
Do you offer no win no fee representation?
No, we do not offer no win no fee arrangements. We know cost is often front of mind when you are considering action against your employer, especially if you are out of work. Before we commence any work, we provide you with a clear and detailed work proposal with all-inclusive fees, so you will know the cost before we get started. Before you commit to anything, book a free 10-minute consult and we will give you our preliminary view, tell you what a matter like yours typically involves, and set out the likely cost from there.
What happens in the free 10-minute consult?
You tell us what is going on and we give you our preliminary view. That usually covers whether you have a legal issue worth pursuing, what your options look like, how a matter like yours typically runs, and what the likely cost would be if you decide to go further. There is no obligation to take it any further after the consult. If we are not the right fit for your matter, we will tell you that too and point you in the right direction where we can.
Can you help with my visa or immigration issue?
No, we do not advise on immigration or visa matters, and we cannot act on anything that touches on those issues, even at the edges. Immigration is a separate specialty with its own registration requirements. If your employment issue is tied up with your visa status, for example your sponsorship or your right to work, you will need a registered migration agent or an immigration lawyer to advise you first. Because of the interrelated nature of visa issues, if your matter has a component relating to immigration, you would be best served by a firm which can deal with both matters under one roof.
I have a workers' compensation claim. Can you act for me?
We do not run workers’ compensation claims ourselves. Those go through a specialist workers’ comp practice and, in NSW and SA, through the relevant state scheme. What we can do is act on the employment issues that often sit alongside a workers’ comp claim. That covers situations like being dismissed after an injury, treated adversely for making a claim, discriminated against because of a disability, or pressured to sign paperwork you do not understand. If you are already working with a workers’ comp lawyer, we are happy to run in parallel on the employment side.
What if my matter goes beyond employment law?
Employment issues often bring other things to the surface. You might be thinking about setting up your own business after leaving, needing your will or estate plan reviewed after a settlement, or working through a structuring question tied up with what is happening at work. When that happens, we work alongside our parent firm ADLV Law, who advise individuals, families, and business owners across areas like business advisory, estate planning, tax and structuring, and commercial matters. If your matter crosses into any of these areas, we will flag it in your consult and work with you to resolve all of your legal issues under one roof.
Do I need to be in Sydney or Adelaide to work with you?
No, we act for clients across Australia. We have offices in Sydney and Adelaide and can meet in person at either, but most of our work runs by phone, video, and email, so where you are based rarely matters. Most employment law in Australia is federal, meaning we can advise on unfair dismissal, general protections, discrimination, and most workplace claims wherever you are. Some entitlements are state-based, like long service leave and some public sector matters, so if your issue turns on state law outside NSW or SA we will tell you upfront and, where needed, work with a local lawyer alongside us.
Still have a question we have not answered?
